Terms Of Service

  1. Acceptance of Terms By accessing or using the software services provided by Rental Tracker Inc ("Software," "Services," or "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use or access the Software. These Terms apply to all users of the Software, including users who access the Software, and any content, data, or services provided through the Software.
  2. Intellectual Property All rights, title, and interest in and to the Software, including but not limited to the source code, documentation, algorithms, graphics, design, and trademarks, are owned by Rental Tracker Inc or its licensors. You may not reverse engineer, decompile, or disassemble the Software unless permitted by applicable law. You agree not to infringe or misappropriate Rental Tracker Inc’s intellectual property.
  3. User Contributions Any content, feedback, or suggestions ("Contributions") you provide to Rental Tracker Inc regarding the Software becomes Rental Tracker Inc’s property, and Rental Tracker Inc is free to use, modify, or incorporate such Contributions without any obligation to you.
  4. Prohibited Uses You agree not to use the Software to:
    • Violate any applicable laws or regulations.
    • Infringe upon or misappropriate the intellectual property rights of Rental Tracker Inc or third parties.
    • Transmit viruses, malware, or other malicious code.
    • Engage in any activity that disrupts or interferes with the Software or its associated servers and networks.
  5. Account Registration and Security You are required to register an account. You agree to provide accurate and complete information during the registration process and maintain the security and confidentiality of your account credentials. You are responsible for all activities under your account.
  6. U.S. Government Rights If our Software is acquired by or on behalf of any agency not within the Department of Defense ("DOD"), the Software is subject to the terms of these Terms of Use in accordance with Federal Acquisition Regulation ("FAR") 12.212 (for computer software) and FAR 12.211 (for technical data). If the Software is acquired by or on behalf of any agency within the Department of Defense, it is subject to the terms of these Terms of Use in accordance with Defense Federal Acquisition Regulation ("DFARS") 227.7202-3.
  7. Software Updates and Maintenance Rental Tracker Inc may release updates, patches, or new versions of the Software from time to time. You agree to install updates or new versions of the Software to maintain compatibility and security.

8. Third-Party Links The Site may contain links to third-party websites. We are not responsible for the content, policies, or practices of these external sites.

  2. Site Management Rental Tracker Inc reserves the right, but not the obligation, to:

  1. Term and Termination These Terms will remain in effect as long as you use the Software. Rental Tracker Inc reserves the right to suspend or terminate your access to the Software at any time, with or without cause, without notice, and without liability. Upon termination, your rights to access and use the Software will immediately cease.
  2. Governing Law These Terms are governed by the laws of the USA, and any disputes shall be resolved in the courts of USA. You consent to the exclusive jurisdiction of these courts.
  3. Dispute Resolution
  • Informal Negotiations: Before initiating arbitration, both parties agree to attempt to resolve disputes informally for at least 30 days.
  • Binding Arbitration: If informal negotiations fail, the dispute will be resolved through binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association ("AAA").
  • Exceptions: Disputes concerning intellectual property, theft, privacy violations, or claims for injunctive relief are not subject to arbitration.

Limitation of Liability To the fullest extent permitted by law, Rental Tracker Inc and its affiliates are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Software, including but not limited to loss of data or profits, even if Rental Tracker Inc has been advised of the possibility of such damages.
  2. Indemnification You agree to defend, indemnify, and hold harmless Rental Tracker Inc and its affiliates from any claims, liabilities, damages, and expenses, including reasonable attorneys' fees, arising from your use of the Software, violation of these Terms, or infringement of any third-party rights.
  3. User Data Rental Tracker Inc may store and process data to provide the Software services.
  4. Electronic Communications, Transactions, and Signatures By using the Software, you consent to receive electronic communications from Rental Tracker Inc. You agree that all agreements, notices, disclosures, and other communications from Rental Tracker Inc satisfy any legal requirement that such communications be in writing.
  5. Miscellaneous
  • These Terms represent the entire agreement between you and Rental Tracker Inc regarding the Software.
  • If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to be in effect.
  • Rental Tracker Inc may assign its rights and obligations under these Terms at any time.
  • The failure to enforce any part of these Terms does not constitute a waiver of those rights.

20.   Changes to Terms We may update these Terms from time to time. Continued use of our Services after modifications constitutes acceptance of the updated Terms.
